These Shipping & Delivery Terms constitute a binding supplementary contractual term applicable to all physical hardware deliveries, peripheral device shipments, tangible product distributions, and paired service deliveries associated with Amkovoy Workspace product solutions. Combined with the company’s Privacy Policy and Terms of Service, these terms govern all logistics, delivery, handover, risk transfer, and after-delivery liability matters between Amkovoy and its commercial clients, end users, and cooperative partners.
1. Scope & Definition
1.1 These terms apply to all shipment and delivery services performed by Amkovoy, its authorized logistics contractors, and third-party fulfillment partners for all tangible goods linked to Workspace product deployment, including office hardware, supporting equipment, customized deployment accessories, and physical delivery of official certification documents.
1.2 Delivery Subject: Refers to all physical goods ordered, purchased, or deployed under Amkovoy Workspace business scenarios;
1.3 Delivery Period: Refers to the period from official order confirmation and payment verification to the completion of goods handover;
1.4 Logistics Service Provider: Refers to certified EU/German local logistics carriers and cross-border freight partners officially authorized by Amkovoy.
2. Order Confirmation & Pre-Delivery Verification
2.1 All delivery arrangements shall be initiated only after formal written order confirmation and full compliance with payment terms. Oral reservations or informal communication content shall not constitute valid delivery execution basis.
2.2 Clients shall undertake full responsibility for the accuracy of delivery address, contact information, and recipient information. Amkovoy shall not be liable for delivery delay, deviation, or loss caused by incorrect or incomplete client-provided logistics information.
2.3 Prior to shipment, Amkovoy reserves the right to conduct pre-delivery inspection on product quality, packaging integrity, and accessory completeness, to ensure compliance with EU product safety standards and local German delivery specifications.
3. Shipment Standard & Packaging Specification
3.1 All goods will be packaged in accordance with international logistics safety standards and German environmental packaging regulations, with anti-collision, dustproof, moisture-proof and anti-extrusion protection measures applicable to electronic and office equipment products.
3.2 Standard packaging is included in the product service fee by default. Customized packaging, exclusive logo printing, special anti-damage packaging and other personalized requirements shall generate additional fees, which shall be confirmed by both parties in writing prior to shipment.
3.3 Each shipment will be attached with standard shipping documents, product qualification certificates, customs declaration documents (for cross-border shipments), and after-sales service instructions, meeting EU and German commercial logistics filing requirements.
4. Delivery Method & INCOTERMS® 2020 Application
4.1 Domestic German Delivery: Adopts DAP (Delivered At Place) Düsseldorf terms by default. Amkovoy shall bear all freight costs and transportation risks until the goods arrive at the designated client delivery address.
4.2 EU Cross-Border Delivery: Adopts DAP Destination Port/City terms. Cross-border logistics procedures, EU border declaration and unified logistics supervision procedures shall be handled by Amkovoy’s designated logistics partners.
4.3 For special designated delivery methods proposed by clients (including expedited shipment, door-to-door exclusive delivery, self-pickup, and designated carrier delivery), both parties shall confirm the adjusted risk division and fee standard in writing separately.
5. Delivery Time & Delay Regulation
5.1 Conventional domestic German orders will be shipped within 3–7 working days after payment confirmation; EU cross-border orders will be shipped within 7–14 working days. The specific delivery time shall be subject to the official order confirmation document.
5.2 Amkovoy shall not be held liable for delivery delays caused by objective uncontrollable factors, including but not limited to official logistics policy adjustment, EU customs inspection delay, traffic control, extreme weather, epidemic prevention control, and force majeure events defined under German BGB.
5.3 For delays caused by Amkovoy’s negligent logistics arrangement, the company will actively coordinate expedited processing and provide corresponding service compensation in accordance with German commercial law standards, without unlimited liability for indirect losses.
6. Risk Transfer & Goods Handover
6.1 In strict accordance with INCOTERMS® 2020 and German HGB provisions, the risk of goods damage, loss or accidental deterioration shall be transferred to the client upon successful on-site handover and signature confirmation.
6.2 Clients shall complete on-site inspection of packaging integrity, goods quantity and appearance damage at the time of delivery. Any apparent damage, missing parts or quantity discrepancy must be put forward in writing on the delivery receipt on the spot; no objection shall be deemed as automatic confirmation of intact delivery.
6.3 For hidden quality problems that cannot be identified by superficial inspection, the client retains the right to file a complaint and apply for remedy within the statutory warranty period stipulated by German law.
7. Logistics Fee & Tax Liability
7.1 Default shipping costs are borne by Amkovoy for standard domestic and EU regional delivery services. Special logistics demands such as remote area surcharge, expedited air freight, and insured transportation shall be borne by the client.
7.2 For cross-border shipments, statutory EU VAT, customs duties and regulatory fees shall be implemented in accordance with the latest EU tariff policies. The tax bearing subject shall be strictly defined by the confirmed INCOTERMS clause of the order.
7.3 All logistics-related invoices and tax documents will be issued in compliance with German tax regulations and can be used for corporate accounting and tax declaration filing.
8. Return & Replacement Shipment Rules
8.1 Return or replacement shipment caused by product quality problems shall be fully borne by Amkovoy, including round-trip freight, customs fees and re-delivery costs.
8.2 Return shipment caused by client’s personal reasons, order adjustment or unnecessary goods return shall be borne by the client for all generated logistics costs, and Amkovoy has the right to deduct corresponding service handling fees in accordance with commercial rules.
8.3 All return and replacement logistics must be confirmed by Amkovoy’s official support team in advance; unauthorized return shipment without official confirmation will not be accepted or processed.
9. Goods Insurance & Loss Handling
9.1 Conventional shipments are covered by basic logistics insurance provided by the carrier. For high-value equipment and customized Workspace supporting hardware, Amkovoy will purchase additional full-value transportation insurance.
9.2 Once goods loss, damage or missing occurs during transportation, Amkovoy will initiate insurance claim procedures and coordinate logistics compensation settlement in accordance with German logistics regulations and insurance contract terms, and complete re-delivery or refund processing as soon as possible.
10. Policy Revision & Supplementary Provisions
10.1 Amkovoy reserves the right to adjust logistics standards, delivery scopes and fee clauses according to EU trade policy updates, German local logistics rule changes and business development needs. Updated terms will be published on the official website synchronously.
10.2 This clause is supplementary to the Privacy Policy and Service Terms. In case of any inconsistency between individual clauses and national laws or EU regulations, the mandatory provisions of laws and regulations shall prevail.
10.3 All delivery disputes shall be settled through friendly negotiation first; if negotiation fails, the dispute shall be submitted to the competent judicial authority in Düsseldorf, Germany for resolution in accordance with German commercial law.
